The Family Law Court – A Playground for Perpetrators of Domestic Violence

Abstract

Domestic violence has competing definitions but it is clear that it involves coercive control and violence. The psychological trauma inflicted through the family law court process using humiliation, degradation, constant criticism, financial abuse, social isolation and threats of taking sole custody of the children to name a few, may be more damaging and long-lasting than physical assaults. Family court proceedings provide perpetrators with a way to continue to control, harass and intimidate their victims with the majority of cases directed at mothers. The constant denigration of a woman’s mothering, the continual “paper abuse” and financial burden of legal costs and the opportunity to intimidate at child changeovers are some of the ways coercive control is invisible yet in plain sight within the family court system. The result is the re-traumatisation and re-victimisation of the mother and their children. There is a lack of understanding of domestic violence by judges, court report writers and lawyers, which means that subtle manifestations of coercive control are missed by these legal officers who should be protecting the parents and their children from further domestic violence. Solutions are proposed to identify and minimise the domestic violence that the family law court is aiding and abetting. The family court is distressing for many reasons and warrants change. The stories of many are told through the voice of Tilly along with her own lived experience demonstrating the challenges of an adversarial system that is the family court. There is a need for more transparency and accountability in family court rather than focusing on the enduring conflict and a system that as a whole is not working. Solutions are offered to Stop Domestic Violence in the family court system and assist in healing those who have already suffered at the hands of the family court legal personnel.

Biography

Dr Jill is a counsellor in her private practice Running Minds. Her main areas of specialisation are neurodiversity, men and women’s wellbeing, narcissistic abuse recovery, family court and domestic violence trauma. Dr Jill is the president of the committee for a not-for-profit organization, which assists women who have left domestic violence to rebuild their life. Dr Jill has first-hand experience of the challenges with child custody issues and the absence of understanding of coercive control within the family court system and how perpetrators use this to continue to inflict pain through power and control.
