Disaster Preparedness, Response and Recovery: Lessons Learnt - a Legal Perspective

Abstract

The increasing frequency and severity of natural disasters are leading many governments to develop dedicated agencies, systems and procurement strategies to deliver better responses to natural disasters.
What are the key legal issues they need to address, and how are they doing it?
Having spent many years advising governments in Australia on disaster response and recovery, Jo and Nick will discuss lessons learnt from working on responses to bushfires, floods and storms. They will share their observations on the increasing sophistication in disaster response, as governments, industry and communities become more experienced in dealing with disasters.
Jo and Nick will discuss key issues and risks related to disaster recovery, response and preparedness from a legal perspective, in areas such as planning and environmental law, contracting / service delivery models and contractual risk allocation, land acquisitions, domestic building law and tenancy laws, by reference to case studies and lived examples.

Biography

Nick is a leading expert in environment, planning, ESG, water, property, regulated industries and government law. He has over 25 years’ experience advising Commonwealth, State and local government clients, as well as private sector clients in a diverse range of industries. Increasingly, Nick's work is focusing on resilience in the built and natural environments. He advises clients on disaster planning and risk management as well as disaster response and recovery. Nick is listed in leading international legal directories and was recently recognised as Australia's leading water lawyer in the AFR Best Lawyers awards.

Biography

Jo has 25 years' experience advising government and private sector clients on complex projects in the Defence, logistics, correctives, energy, telecommunications and social housing sectors. Jo's unique experience in disaster response and recovery spans long term advice to the Victorian Government (since 2009) and the NSW Government (since 2022) regarding disaster events, including immediate response, reconstruction activities and funding arrangements. Jo also specialises in WHS law and advises on contamination risk and safety obligations arising from disaster recovery and clean-up activities / recovery activities.
